Fireplace Furnaces Gate/Grate+ Heaters
Warranty - For one year from the date of purchase, Fireplace Furnaces will repair or replace any Grate/Grate+ Heater (excluding the units diamond mesh screen and fasteners), or electrical blowers found defective in material, construction or workmanship under normal use and following care instructions. Including all associated shipping and handling cost. For the Second year, from date of purchase, we will repair or replace any Grate/Grate+ Heater component found defective in material, construction or workmanship under normal use and following care instructions excluding the electrical blower and the same first year exclusion with shipping and handling to be shared – you pay to me, I pay to return.
Note: This Warranty excludes injury, loss of use, damage, failure to function due to accident, negligence, misuse, improper installation, alteration or modification of the unit, lack of proper and regular maintenance, damage incurred while the appliance is in transit or act of God. Any damage to Fireplace, hearths, facing, mantels, venting, flue, and any other fireplace components caused by normal wear and tear, such as discoloration, chipping of firebrick, creosote buildup, etc. Also excluded is any damage to the unit caused by abuse, improper use or misuse of product, or the use of fuel other than that for which the unit is designed (use cord wood only).
Limitation of Liability. - Under no circumstances shall the manufacture or seller be liable to you or any third party on account of your use or misuse of the product. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary and punitive damages whether any such claim is based on warranty, contract, tort (including negligence) or otherwise (even if the manufacture and/or seller has been advised of the possibility of such damages). Such limitation of liability shall apply whether the damages arise from use or misuse of the product (including such damages incurred by third parties). Such limitation shall apply notwithstanding a failure of essential purpose of any limited remedy and to the fullest extent permitted by law. Some states or other jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations and exclusions may not apply to you.
Indemnification: You agree to indemnify and hold harmless the product’s manufacture and seller from any claim or demand, made by any third party due to or arising directly or indirectly out of your conduct or in connection with your use of the product, any alleged violation of these terms and conditions, and/or any alleged violation of any applicable law or regulation.
Buyer should contact seller prior to use if there are any issues with the product’s compliance to local code or laws prohibiting or regarding its use for full product purchase refund. Buyers purchase constitutes full acceptance and agreements with the warranty terms, liability limitation and Indemnification terms here set forth.
